29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. At a job site located at 8519 Green Hills Rd Kansas City, Missouri: The employer is failing to protect employees from exposure to struck by hazards. This was most recently documented on or about October 24, 2019, when an employee was observed working in an excavation and the excavated materials posed a hazard of rolling into the excavation. The excavated materials (spoil pile) was not distinguishable from the edge of the face of the excavation. Havens Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(j)(2) which was contained in OSHA inspection number 1274197, citation number 1, item number 1 and was affirmed as a final order on June 29, 2018, with respect to a workplace located at 6732 Holmes Kansas City, Missouri.

At a job site located at 8519 Green Hills Rd Kansas City, Missouri: The employer is failing to protect employees from exposure to cave-in hazards. This was most recently documented on or about October 24, 2019, when an employee was observed working in an excavation that was greater than 5 feet deep with a vertically sided lower portion that was not shielded or supported as per Appendix B of Subpart P, slope configurations for excavations made in type B soil.
