29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  a. On or about November 5, 2019 on the job site located at 988 Zeller Drive, Lot 615, Pickerington, OH 43147, employees working below residential framing operations were not wearing protective helmets to protect against impact or from falling wood, nails, and other framing materials and tools.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about November 5, 2019 on the job site located at 988 Zeller Drive, Lot 615, Pickerington, OH 43147, employees were using pneumatic nail guns and circular saws while framing the second story of a residential structure without utilizing eye protection thereby exposing employees to being struck by flying nails and wood particles.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about November 5, 2019 on the job site located at 988 Zeller Drive, Lot 615, Pickerington, OH 43147, employees were exposed to a fall hazard while using a portable extension ladder to access the second story of the residential structure. The ladder did not extend at least three-feet above the second level landing surface of the residential structure.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.    This most recently occurred on November 5, 2019, at the residential site located at 988 Zeller Drive, Lot 615, in Pickerington, Ohio. The employer failed to ensure employees performing framing work from the second floor were protected from fall hazards while setting walls, thereby exposing them to an approximately eleven foot fall hazard.    MMD Framing, LLC was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which contained inspection numbers:    1) 1390339, Citation 2  Item 1, Issued on 05/23/2019 2) 1330328, Citation 2  Item 1, Issued on 07/31/2018 2) 974283, Citation 1  Item 1, Issued on 05/16/2014    Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a.  On or about November 5, 2019 on the job site located at 988 Zeller Drive, Lot 615, Pickerington, OH 43147, employees were framing a two-story residential structure and were exposed to fall hazards. The employer failed to provide fall protection training for employees  to recognize and minimize the fall hazards.

On or about November 5, 2019 on the job site located at 988 Zeller Drive, Lot 615, Pickerington, OH 43147, the employer failed to develop and maintain a safety and health program to ensure hazards were identified and corrected onsite while performing framing work.    MMD Framing, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1390339, citation number 3, item number 1 and was affirmed as a final order on June 18, 2019, with respect to a workplace located at 12365 Ebright Lane in Pickerington, Ohio.   MMD Framing, LLC was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1330328, citation number 1, item number 1 and was affirmed as a final order on August 22, 2018, with respect to a workplace located at 85 Cloverhill Drive in Galloway, Ohio.
