29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.   a.  Located at 11687 Begonia Drive, Plain City, OH 43064:  On or about August 31, 2022, employees working on a residential framing project were not protected by accident prevention programs designed to address common residential construction hazards, which exposed them to fall and struck-by hazards.  MMD Framing, LLC was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1442754, citation number 3, item number 1 and was affirmed as a final order on February 22, 2020, with respect to a workplace located at 988 Zeller Drive, Lot 615, Pickerington, OH 43147.  MMD Framing, LLC was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1390339, citation number 3, item number 1 and was affirmed as a final order on June 18, 2019, with respect to a workplace located at 12365 Ebright Lane in Pickerington, Ohio.   MMD Framing, LLC was previously cited for a violation of this Occupational Safety and Health standard, 29 CFR  1926.20(b)(1), which was contained in OSHA inspection number 1330328, citation number 1, item number 1 and was affirmed as a final order on August 22, 2018, with respect to a workplace located at 85 Cloverhill Drive in Galloway, Ohio.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a.  Located at 11687 Begonia Drive, Plain City, OH 43064:  On or about August 31, 2022, employees working on a residential framing project were not protected from falls while framing the porch overhang that measured approximately 9 feet from the ground, exposing them to fall hazards.  b.  Located at 11687 Begonia Drive, Plain City, OH 43064:  On or about August 31, 2022, employees working on a residential framing project were not protected from falls while working at or near an unguarded floor opening between the second floor and the first floor at the stairway, which exposed employees to a fall hazard from approximately 9 feet.  c.  Located at 11687 Begonia Drive, Plain City, OH 43064:  On or about August 31, 2022, employees working on a residential framing project were not protected from falls while working at or near an unguarded floor opening between the basement and first floor stairway, which exposed employees to a fall hazard from approximately 9 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a.  Located at 11687 Begonia Drive, Plain City, OH 43064:  On or about August 31, 2022, employees working on a residential framing project were not trained to recognize or mitigate fall hazards before working on a residential construction project that exposed them to fall hazards measuring approximately 9 feet. Located at 11687 Begonia Drive, Plain City, OH 43064:  On or about August 31, 2022, the employer did not ensure that each employee using a pneumatic nail gun to perform  framing operations on an under-construction porch overhang utilized eye protection, exposing them to struck-by hazards from flying particles.
