29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about November 6, 2019, the employer had not trained employees exposed to hazardous chemicals such as, but not limited to nitrogen, oxygen, iron, and manganese which are included in carbon steel and the laser processing gas system which employees may be exposed to when operating the Mitsubishi Laser Processing Machine. Training should cover the written hazard communication program, health hazards associated with the chemical, methods to detect the release of the hazardous chemicals, measures employees can take to protect themselves from exposure to the chemicals and safety data sheets including where employees can access them.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about November 6, 2019, the employer did not evaluate the respiratory hazards for employees exposed to hazards associated with chemicals such as, but not limited to iron oxide and manganese which are in sheets of carbon steel and may be released when cut on the Mitsubishi Laser Processing Machine.
