29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a- 926 Dogleg Lane, Lawrenceville NJ: A worker was exposed to fall hazards, in excess of 12 feet to the ground surface below, when working from an unsecured, portable, aluminum extension ladder whose side rails did not extend three feet above the upper landing being accessed. Condition observed on or about 11/07/19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  a- 926 Dogleg Lane, Lawrenceville NJ: A worker was exposed to fall hazards, in excess of 12 feet to the ground surface below, when working from a portable, aluminum extension ladder that contained visibly damaged rungs and side rails. Condition observed on or about 11/07/19.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a- 26 Dogleg Lane, Lawrenceville NJ: A company worksite worker was exposed to struck by hazards when using portable circular saw without eye or face protection. Condition observed on or about 11/07/19.   DeCosta Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1398036, citation number 1, item number 2 and was affirmed as a final order on 06/19/19, with respect to a workplace located at 22 Rocksbury Road, Mahwah NJ.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  a- 26 Dogleg Lane, Lawrenceville NJ: A worker was exposed to fall hazards, up to and in excess of 12 feet to the fround surface below, when walking/working from a residential structure's pitched porch roof without the use of fall protection.  Condition observed on or about 11/08/19.   DeCosta Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1398036, citation number 1, item number 1 and was affirmed as a final order on 06/19/19, with respect to a workplace located at 22 Rocksbury Road, Mahwah NJ.
