29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a) Building Exterior: A Power Pro Pettibone All Terrain Forklift was left unattended with the hoisting boom was fully extended to the truss with lumber, Condition noted on or about 05/19/20.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  DeCosta Enterprices Inc., and Fabricio DeCosta does not ensure that employees use appropriate eye protection when exposed to eye injury hazards, including but not limited to when using tools such as a circular electric saw, a pneumatic nail gun and a hammer. This violation was most recently observed at 10 Braeburn Court, Mahwah, NJ, at instance (a): Exterior Framing- where employees were not wearing any eye protection while engaged in framing activities using a circular electric saw, and pneumatic guns, on or about 5/19/2020. To abate this violation the employer must ensure that its employees performing framing work are protected from eye injury and that no employee is allowed to be exposed to eye injuries without wearing proper eye protection.   DeCosta Enterprises Inc was previously cited for repeat violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR  102 (a)(1), which was contained in OSHA Inspection Number  1398036  and 1443478.  In regards to Inspection Number 1398036, Citation #01, Item # 02, was issued on 05/20/2019 to a workplace located at 22 Rocksbury Road, Mahwah NJ 07430. This citation became a final order on 06/19/2019 (DCAT).  In regards to Inspection Number 1443478, Citation # 02, Item # 01, was issued on 12/18/2019 to a work place located at 26 Dogleg Lane, Lawrenceville NJ 08648. This citation became a final order on 01/29/2020 (DCAT).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:   DeCosta Enterprises Inc, and Fabricio DeCosta does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 5/19/2020, at 10 Braeburn Court, Mahwah, NJ, at instance (a): Exterior Framing- where employees were engaged in wood framing activities and were exposed to fall hazards of approximately 15 feet while installing wood trusses near the exterior edge without any method of fall protection. To abate this violation the employer must ensure that its employees performing framing work are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 foot or more without adequate fall protection.  DeCosta Enterprises Inc was previously cited for repeat violations of this Occupational Safety and Health standard or its equivalent standard, 29 CFR  501 (b)(13), which was contained in OSHA Inspection Number 1398036  and 1443478.  In regards to Inspection Number 1398036, Citation #01, Item # 001, was issued on 05/20/2019 to a workplace located at 22 Rocksbury Road, Mahwah NJ 07430. This citation became a final order on 06/19/2019 (DCAT).  In regards to Inspection Number 1443478, Citation # 02, Item # 02, was issued on 12/18/2019 to a work place located at  26 Dogleg Lane, Lawrenceville NJ 08648.
