29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service: NEX outside rear of building: the employer did not remove a forklift from service that was not in safe operating condition in that the Hyster H60XL-MIL-Outdoor forklift was found to have inoperable safety belt, torn seat, and fire extinguisher gauge unreadable. Employees were operating the forklift to transport pallets to and from the warehouse. Employees were exposed to struck-by and crushing hazards. Removal of unsafe equipment from the facility/shop ensures that employees do not use the equipment and place themselves or others in harms way.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, or were placed in service if the examination showed conditions adversely affecting the safety of the vehicle. NEX: inside warehouse and outdoor loading dock: Powered industrial trucks such as the Hyster H60XL-Mil-Outdoor forklift and the Yale Lift Truck MPB040-EN24T2748 was operated without daily inspections to ensure operating conditions were safe for employee's use. Employees exposed to struck-by and crushing injuries.
