29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service:  NEX outside rear of building: the employer did not remove a forklift from service that was not in safe operating condition in that the Hyster H60XL-MIL-Outdoor forklift was found to have inoperable safety belt, torn seat, and fire extinguisher gauge unreadable.  Employees were operating the forklift to transport pallets to and from the warehouse. Employees were exposed to struck-by and crushing hazards. Removal of unsafe equipment from the facility/shop ensures that employees do not use the equipment and place themselves or others in harms way.
