29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from caveins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (i) Excavations are made entirely in stable rock; or (ii) Excavations are less than 5 feet in depth and examination of the ground by a competent person provides no indication of a potential cavein: a) Employees were exposed to excavation collapse hazard when installing a new 6 inch sewer pipe in the 12 ft deep excavation; employer placed a few vertical sheeting planks but did not fully shore/ support the dirt walls of the excavation. Location: 141 Broadway, Brooklyn NY On or about 12-18-2019 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
