29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: A) Cooper Farms, Inc., located at 2351 Wabash Road, Fort Recovery, OH 45846: On or about December 16, 2019, the employer did not ensure that employees were protected from fall hazards while working on the East end of the platform located next to the West Drag Conveyor at the East Mill. Employee were working on the East end of the platform while conducting maintenance and troubleshooting of the West Drag conveyor and were exposed to the fall hazards of approximately 50 feet from the platform to the ground below.

29 CFR 1910.147(f)(1)(ii): Employees were not removed from the machine or equipment area in accordance with paragraph (e)(2) of this section during testing or positioning of machines, equipment or components thereof: A) Cooper Farms, Inc., located at 2351 Wabash Road, Fort Recovery, OH 45846: On or about December 16, 2019, the employer did not ensure that all employees were safely positioned or removed from the area of the West Drag Conveyor, located at the East Mill, when the conveyor was energized/started in order to conduct testing/troubleshooting. The exposed employees were standing in a close proximity to the running conveyor after it was energized and were exposed to struck-by and caught-by hazards that could result in serious injuries.
