29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: On or about January 8, 2020, during the installation of roofing/framing material at a job site located at 1010 Dunway Ave NE, Canton, Ohio 44720; the employer did not ensure employees working on the ground directly below an employee working on the roof of a single family home was protected from possible head injury from falling and or flying debris. The Ben Miller Builders was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.100(a) Head Protection), which was contained in OSHA inspection number 1422059, citation number 01, item number 01 and was affirmed as a final order on (9/23/19), with respect to a workplace located at 2594 Carlton St NW, Canton, Ohio 44720.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about January 8, 2020, during the installation of roofing/framing material at a job site located at 1010 Dunway Ave NE, Canton, Ohio 44720; the employer did not ensure employees working on a roof of a single family home were protected from a fall of approximately 12.5 feet by utilizing a fall protection system. The Ben Miller Builders was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13) Duty To Have Fall Protection), which was contained in OSHA inspection number 1422059, citation number 01, item number 03 and was affirmed as a final order on (9/23/19), with respect to a workplace located at 2594 Carlton St NW, N.
