29 CFR 1910.178(l)(2)(ii) is applicable to construction employment as referenced by 1926.602(d): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:    The employer is failing to protect employees from a struck by hazard when operating an all terrain forklift, powered industrial truck, at a commercial construction site. This was most recently documented on or about January 28, 2020 at 1424 East 26th Street, Fremont, NE 68025. Operator of the powered industrial truck had not successfully completed the training required by paragraph (l) of the standard. An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years.

This was most recently documented on or about January 28, 2020 at 1424 East 26th Street, Fremont, NE 68025 at a commercial construction jobsite where the employer has employees operating pneumatic nail guns while setting trusses.

This was most recently documented on or about January 28, 2020 at 1424 East 26th Street, Fremont, NE 68025 when employees were observed setting trusses on a commercial structure while working at greater than 6 feet above the ground without fall protection.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:    The employer is failing to protect employees from fall hazards associated with accessing upper areas during commercial framing construction. This was most recently documented on or about January 28, 2020 at 1424 East 26th Street, Fremont, NE 68025.  Employees climbed the sides of a framed structure to access upper areas at heights exceeding 16 feet where they were setting trusses without the means listed in the standard.
