29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At a Residential construction site located at 6728 Rockhill Rd, KC MO -- Employees were exposed to harmful chemicals that could cause injuries and/or illnesses in that the employer had not developed, or implemented, a written hazardous communication program., This was demonstrated at the residential construction site when 6 employees were dispensing gasoline that was used to power the air compressor for the pneumatic nail guns.   Hernandez Construction and Moore LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 1256457, citation number 1, item number 1, and was affirmed as a final order on 04/18/2018, with respect to a workplace located at 3631 Bell St, KC MO.  Hernandez Construction and More LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200(e)(1), which was contained in OSHA inspection number 1275879, citation number 1, item number 2 and was affirmed as a final order on 02/01/2018, with respect to a workplace located at 13906 Timberidge St, KC MO 64152.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  At a residential construction site located at 6728 Rockhill Rd, KC MO: Employees were using a pneumatic nail gun while engaged in roofing activities but were not using proper eye or face protection to protect them flying debris. This was documented on or about 01/30/2020.  Hernandez Construction and More LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1256457, citation number 1, item number 1 and was affirmed as a final order on 04/18/2018, with respect to a workplace located at 1236 Horizon Dr, Blue Springs MO 64015.  Hernandez Construction and More LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA inspection number 1275879, citation number 1, item number 1 and was affirmed as a final order on 02/01/2018, with respect to a workplace located at 13906 Timberidge St, KC MO 64152.
