29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Small potatoes sorting area: On or about January 30, 2019 an at times prior thereto; employer did not conduct periodic inspections of energy control procedures or adequate training to affected employees to include machine operators and assistant maintenance personnel who make repairs and perform maintenance above operator level maintenance.   b) Five pound line: On or about January 30, 2019 an at times prior thereto; employer did not conduct periodic inspections of energy control procedures or adequate training to affected employees to include machine operators and assistant maintenance personnel who make repairs and perform maintenance above operator level maintenance.   c) Bagger Area: On or about January 30, 2019 an at times prior thereto; employer did not conduct periodic inspections of energy control procedures or adequate training to affected employees to include machine operators and assistant maintenance personnel who make repairs and perform maintenance above operator level maintenance on the Volmpak Auto-baler.     Note* Abatement certification IS required for this item.

29 CFR 1910.147(c)(6)(i): The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:  a) Small potatoes sorting area: On or about January 30, 2019 and at times prior thereto; Maintenance assistants, and machine operators participated in the servicing and maintenance of belts and bearings on conveyors, but energy control practices did not follow the requirements of the standard; employer did not determine whether lock out procedures for a crew making repairs were sufficient to protect against reenergization of the equipment.     b) Five pound line: On or about January 30, 2019 and at times prior thereto; Maintenance assistants, and machine operators participated in the servicing and maintenance of belts and bearings on conveyors, but energy control practices did not follow the requirements of the standard; employer did not determine whether lock out procedures for a crew making repairs were sufficient to protect against reenergization of the equipment.     c) Bagger area - Volmpak Auto-balers: On or about January 30, 2019 and at times prior thereto; Maintenance assistants, and machine operators participated in the servicing and maintenance of Volpak Auto-balers lines, but energy control practices did not follow the requirements of the standard; employer did not determine whether lock out procedures for a crew making repairs were sufficient to protect against reenergization of the equipment. 29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Small potatoes sorting area: On or about January 30, 2020, and at times prior thereto; rotating conveyor located beside a sorter's step stool presented a caught-in hazard for employees engaged in servicing, maintenance, and sorting operations.   b) Five pound line: On or about January 30, 2019 and at times prior thereto; maintenance personnel, sorters, and machine operators entered and exited work areas with unguarded rotating overhead conveyors, which exposed them to overhead caught-in hazards.    c) Bagger Area: On or about January 30, 2019 and at times prior thereto; Volmpak Auto-baler was missing a side guard, exposing the point of operation on the left side of the machine.
