29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident: (a) On June 12, 2025, an employee was hospitalized after being struck by a forklift when he walked out of the lunchroom and into the path of the forklift. The employee died as a result of his injuries on June 17, 2025, and the employer did not report the death to OSHA.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushing injuries when operating a forklift without the use of a restraint device: (a) Lower Packaging Area, on June 12, 2025, an employee operated a UniCarriers Americas Corporation forklift model MCU1F2A25LV, S/N CU1F2-9Q21565, without the use of a personal restraint system. NOTE: Abatement certification is required for this item.

29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances were not allowed for aisles, at loading docks, through doorways or wherever turns or passage had to be made. Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways were not appropriately marked. (a) Lower Packaging Area, on June 12, 2025, employees were exposed to struck by or crushing injuries from powered industrial truck operations while walking through high traffic areas. Employees regularly returning from the lunchroom to their workstations walk through a doorway that opens directly into the path of the powered industrial trucks.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training in relevant topics was not provided to the operator when the operator was involved in an accident or near-miss incident: (a) On June 13, 2025, an employee was directed to operate a forklift after being involved in an accident on June 12, 2025. Employees working in nearby areas were exposed to struck by or crushing injuries. b) Between June 23 and June 25, 2025, an employee operating a forklift struck a yellow pole in the facility causing damage to one of the forks. As of July 2, 2025, the operator continued to drive the forklift but did not receive any type of retraining or evaluation.
