29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:    a) Ball, Bounce, and Sport, Inc. (d.b.a. Hedstrom Plastics.) located at 211 West Geneva Street in Dunkirk, Ohio. On or about February 4, 2020 the employer did not ensure employees who were exposed to noise levels at or above an eight hour time weighted average of 85 decibels were provided with audiometric testing. Employees exposed to noise levels at or above 85 decibels were exposed to hazards such as but not limited to temporary and long term hearing loss.

29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program:  a) Ball, Bounce, and Sport, Inc. (d.b.a. Hedstrom Plastics.) located at 211 West Geneva Street in Dunkirk, Ohio. On or about February 4, 2020 the employer did not ensure that employees exposed to noise levels at or above 85 decibels were provided with hearing conservation training consisting of the following information:    a)       The effects of noise on hearing;  b)       The purpose of hearing protectors, the advantages, disadvantages, and attenuation of various types, and instructions on selection, fitting, use, and care; and  c)       The purpose of audiometric testing, and an explanation of the test procedures.     Employees exposed to noise levels at or above 85 decibels were exposed to hazards such as but not limited to temporary and long term hearing loss.

On or about February 4, 2020 the employer did not ensure equipment was approved for the class of the location it is used. Employees were exposed to fire hazard in that the Nortech Compressed Air-Powered Vacuum used in the mixing area was not rated for use in class I, II, or III locations.

(d.b.a. Hedstrom Plastics.) located at 211 West Geneva Street in Dunkirk, Ohio. On or about February 4, 2020 the employer, in which there is a potential for airborne levels, did not inform employees of the contents of Appendices A and B of OSHAs 1910.1025 regulation. Employees working in the mixing area and at the spin molding machines are exposed to hazards associated with lead such as headaches, fatigue, abdominal pain, and possible lead poisoning.

On or about February 4, 2020 the employer did not ensure surfaces were maintained as free as practicable of accumulations of cadmium. Employees working in the mixing area were exposed hazards associated with cadmium in that the work table in the mixing area had accumulations of cadmium, 16.8 micrograms per 100 square centimeters, on its surface.
