29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On or about February 5, 2020, the Hyster Model E70XN-40 forklift (Serial No. A268N27430T) did not have a plate, tag or decal which indicated the maximum capacity, operation and maintenance instructions for employees operating the lift with the Cascade Model 24H-RCP-B003 Clamp attachment.

29 CFR 1910.178(o)(2): Only loads within the rated capacity of the truck shall be handled. Employees using the Hyster Model E70XN-40 forklift (Serial No. A268N27430T), with the Cascade Model 24H-RCP-B003 Clamp attachment, were exposed to potential struck-by and crushing hazards when the lift was being used to lift paper rolls beyond the rated maximum capacity of the lift with that attachment.
