29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a) Rodriguez Construction, LLC located at 715 Lorenzo Drive, Marysville, OH 43224: On and preceding February 11, 2020, employees were framing in trusses and walls on a two story residential home at heights up to 18 feet without fall protection or other PPE. The employer did not initiate and maintain safety and health programs related to the framing work being conducted by employees.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Rodriguez Construction, LLC located at 715 Lorenzo Drive, Marysville, OH 43224: On and preceding February 11, 2020, the employer did not instruct employees in the recognition and avoidance of unsafe conditions and the procedures to be followed in order to minimize these hazards. Framers were installing deking and other framing pieces on the top of the second floor of a home at heights up to 18 feet. The employees were not utilizing proper eye or fall protection which exposed them to falls up to 18 feet and struck by hazards to the eyes.

29 CFR 1926.102(a)(1): Employees were not provided with eye and face protection equipment when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a) Rodriguez Construction, LLC located at 715 Lorenzo Drive, Marysville, OH 43224: On and preceding February 11, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were installing wood decking and other framing pieces using a pneumatic nail gun and a circular saw to cut the pieces. The employees were not utilizing eye protection which exposed them to struck-by hazards to the eyes.

Framers were installing wood decking and other framing pieces on top of the second floor at heights up to 18 feet. The employees were not utilizing any form of fall protection which exposed them to falls up to 18 feet.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    a) Rodriguez Construction, LLC located at 715 Lorenzo Drive, Marysville, OH 43224: On and preceding February 11, 2020, the employer did not ensure that the portable ladder used to gain access to the roof and exterior walls extended at least three feet beyond the eave that they were using for access.  Framers were utilizing a self-supporting ladder to access the top of the second floor of a two story residential home which was positioned approximately 10 inches below the upper landing they were accessing.  The following condition exposed employees to falls up to 9 feet.
