The employee was framing a window with one foot on the step ladder and the other foot was on the window frame. The employee was standing with his back toward the ladder, on or about 2/20/20.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   Frame Q does not ensure that employees use appropriate fall protection while engaged in residential construction activities 6 feet (1.8 m) or more above lower levels. This violation was most recently observed, on or about 2/20/20, at 20 West Central Blvd ,Palisades, NJ, at instance:  a) Building First floor: An employee was exposed to a fall hazard of approximately 10 feet while discarding debris onto plywood set on forks of a rough terrain forklift through an inadequately guarded wall opening, on or about 2/20/20.   b) Building second floor: An employee was engaged in window wood framing activities and was exposed to fall hazards of approximately 25 feet while standing on top of the window frame and a step ladder without any method of fall protection in place, on or about 2/20/2020.  To abate this violation the employer must ensure that its employees performing framing work are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 foot or more without adequate fall protection.  Frame Q LLC was previously cited REPEAT for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1329463, citation number 02, item number 02 and was affirmed as a final order on 2/6/19, with respect to a workplace located at 417 3rd St, Palisades Park, NJ 07650  Frame Q LLC was previously cited REPEAT for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1149505, citation number 01, item number 02 and was affirmed as a final order on 03/22/2018, with respect to a workplace located at 119 Abbott Ave, Palisades Park, NJ 07650. BB Frame LLC dba Frame Q LLC, as successor to Frame Q LLC, and Juan Quevedo does not ensure that employees use appropriate eye protection when exposed to eye injury hazards, including but not limited to when using tools such as a circular electric saw, a pneumatic nail gun, and a hammer. This violation was most recently observed at 700 Palisades Ave., Cliffside Park, NJ, at instance (a): Exterior Framing- where employees were not wearing any eye protection while engaged in framing activities using a circular electric saw, and pneumatic gun, on or about 12/5/19 and 12/6/19. To abate this violation the employer must ensure that its employees performing framing work are protected from eye injury and that no employee is allowed to be exposed to eye injuries without wearing proper eye protection.   a) Second floor: An employee was using a nail gun to install window framing on a two story residential house without the use of eye protection, on or about 2/20/20   Frame Q LLLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1329463, citation number 2, item number 1 and was affirmed as a final order on 2/06/2019, with respect to a workplace located at 417 3rd Street, Palisades Park, NJ 07650.  Frame Q LLLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1071019, citation number 2, item number 2 and was affirmed as a final order on 3/08/2018, with respect to a workplace located at Abbot Boulevard, Fort Lee, NJ 07024.
