29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On March 17, 2020 at 2670 Monroe Road in Bellevue, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards associated with employees utilizing a scissor lift without reconnecting the safety chain and climbing work platform guardrails to access/egress a roof surface.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. On March 17, 2020 at 2670 Monroe Road in Bellevue, employees were using a scissor lift's guardrails to climb thirty-nine inches to access/egress a roof surface; the lift platform was positioned below the top of a parapet wall.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On March 17, 2020 at 2670 Monroe Road in Bellevue, employees were using a scissor lift platform sixteen feet above surface level to access/egress a roof surface without a complete fall protection guardrail system; the mid-level safety chain was not reconnected to provide mid-rail protection.
