29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:   a)     New Construction, Roof:  On or about 3/19/2020, and at times prior, the employer exposed employees to amputation hazards, in that he failed to ensure that the employees were using the Makita 7-1/4 circular saw in accordance with the user manual. The employees had the blade guard shimmed in the open position while conducting framing activities.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around the opening   a)     New Construction, Roof:  On or about 3/19/2020, and at times prior, the employer exposed employees to fall hazards, in that a guard rail system or floor covering was not provided for employee who were traversing on the second floor of a new construction building while conducting framing activities. The height from the floor opening to the floor below was measure at 10 foot 3 inches.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:   a)     New construction, Interior:  On or about 3/19/2020, and at times prior, the employer exposed employees to fall   hazards, in that the employer did not ensure that the stairways going to the second floor did not have a stair rails system in place. The Stairway leading to the second floor had more that 4 risers and was measured at 5 foot 5 inches to the first landing.

29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.   a)     New Construction, roof:  On or about 3/19/2020 , and at times prior, the employer exposed employees to struck by hazards, in that safety glasses were not provided to employees while operating a Makita circular saw conducting framing activities.   Jorge Barrera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1414953, citation number 1, item number 1 and was affirmed as a final order on 9/13/2019 , with respect to a workplace located at 205 Maple Hill Dr. Lot 489 Heritage Ridge, Newnan, GA.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a)     General Store, West exterior wall:  On or about 3/19/2020, and at times prior, the employer exposed employees  to fall hazards, in that, employees were working from a 4-12 pitched new construction roof at eave heights of 19 feet and 4 inches from the lower level and were not provided with a fall protection systems while engaged in framing activities.    Jorge Barrera was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number1414953, citation number 1, item number 2 b and was affirmed as a final order on 9/13/2020, with respect to a workplace located at 205 Maple Hill Dr. Lot 489 Heritage Ridge, Newnan, GA.

29 CFR 1926.25(a): During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  a)    New Construction, Exterior:  On or about 3/19/2020, and at times prior, the employer exposed employees to slips, trips, and fall hazards in that the area around the construction site was not cleaned and debris removed as construction progressed. The employees were involved in framing activities.
