29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  a) New residential construction located on Lot #347, West side of structure: On or about 03/19/2020, and at times prior, the employer exposed employees to struck-by hazards while operating pneumatic nail guns, in that protective eyewear was not provided to employees engaged in siding installation while operating these tools at 120 PSI.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:  a) New residential construction located on Lot #347, West side of structure at cut bench: On or about 03/19/2020, and at times prior, the employer exposed employees to severe laceration and/or amputation hazards while operating circular saws, in that the lower guards were not operational while cutting siding with a wood shim placed in each circular saw.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a) New residential construction located on Lot #347, West side of structure on pump jack scaffold: On or about 03/19/2020, and at times prior, the employer exposed employees to fall hazards of 22-feet 1-inch to the lower level, in that a fall protection system was not provided to employees installing siding from a pump jack scaffold system.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a) New residential construction located on Lot #347, West side of structure at cut bench: On or about 03/19/2020, and at times prior, the employer exposed employees to silica dust exposure while cutting Hardie-Plank Siding, in that the Makita 7-1/4-inch circular saw used to cut a fiber cement product was not equipped with a dust collection system as required by Table-1 when working with materials containing crystalline silica.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:  a) New residential construction located on Lot #347, West side of structure at cut bench: On or about 03/19/2020, and at times prior, the employer failed to inspect all electrical cords and electrical equipment prior to start of shift, in that electrical cords for the Makita circular saw had a damaged strain relief and an orange 50-ft. extension cord had a torn and frayed outer casing and were not repaired or removed from service.
