29 CFR  1926.452(k)(3):The ladder jack was not designed and constructed to bear on the side rails and ladder rungs or on the ladder rungs alone. If bearing on the ladder rungs only, the bearing area did not include a length of at least 10 inches (25.4 cm) on each rung.  New residential construction located on Lot #373, 814 Parker Pass, Peachtree City, GA 30269, East gable side, lower roof area: On or about 05/17/2021, the employer exposed employees to collapse/fall hazards of 19-feet, 5-inches to the lower ground level, in that the ladder jacks were not installed so that the rung support arms were set fully onto both ladder rungs as required by the manufacturer.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    New residential construction located on Lot #373, 814 Parker Pass, Peachtree City, GA 30269, East gable side, lower roof area: On or about 05/17/2021, the employer exposed employees to fall hazards of 9-feet, 8-inches to the lower ground level, in that a fall protection system was not provided to employees using the 10/12 pitched roof as a walking/working surface to access the ladder jack scaffold to install siding on the gable wall.

29 CFR  1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:   a) New residential construction located on Lot #373, 814 Parker Pass, Peachtree City, GA 30269, East gable side, lower roof area: On or about 03/19/2020, and at times prior, the employer exposed employees to fall hazards of 19-feet, 5-inches to the lower level, in that a fall protection system was not provided to employees installing siding from a ladder jack scaffold system.  Smiley Siding & Roofing Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1470733, citation number 1, item number 3 and was affirmed as a final order on 05/18/2020, with respect to a workplace located at Lot #347 Palmer Street, Peachtree City, GA 30269.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a) New residential construction located on Lot #373, 814 Parker Pass, Peachtree City, GA 30269, East gable side at garage entrance: On or about 05/17/2021, and at times prior, the employer exposed employees to silica dust exposure while cutting Hardie-Plank Siding, in that the Makita 7-1/4-inch circular saw used to cut a fiber cement product was not equipped with a dust collection system as required by Table-1 when working with materials containing crystalline silica.  Smiley Siding & Roofing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1153(c)(1), which was contained in OSHA inspection number 1470733, citation number 1, item number 4 and was affirmed as a final order on 05/18/2020, with respect to a workplace located at Lot #347 Palmer Street, Peachtree City, GA 30269.
