29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) Tysinger Construction, LLC located at 4645 Winding Oak Drive, Delaware, OH 43015: On and preceding May 22, 2020, the employer did not ensure that a stairway, ladder, ramp or other safe means of egress was accessible in a 5 to 7 foot deep basement excavation where employees were working. The ladder used for access/egress was located in a trench that intersected with the excavation on the south end of the site. A large pile of dirt was located in the spot where the trench opened into the basement excavation which blocked access to the ladder. The following condition exposed employees to struck-by/caught-in hazards.
