29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Tysinger Construction LLC located at 6500 Bell Crossing, Westerville, OH 43081: On and preceding July 9, 2021, the employer did not ensure that a stairway, ladder, ramp or other safe means of egress was accessible in a 7 to 9 foot deep excavation where an employee was working. An employee was working in a trench which varied from 7 to 9 feet on a residential sewer tie in without a ladder or other means of egress in place. The following condition exposed employees to struck-by/caught-in hazards. Tysinger Construction LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1487830, citation number 1, item number 1, and was affirmed as a final order on 10/12/2020, with respect to a workplace located at 7070 Ringbill Loop SUNBURY, OH, 43074 Tysinger Construction LLC was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1476185, citation number 1, item number 1, and was affirmed as a final order on 02/04/2021, with respect to a workplace located at 4645 Winding Oak Drive DELAWARE, OH, 43015

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) Tysinger Construction LLC located at 6500 Bell Crossing, Westerville, OH 43081: On and preceding July 9, 2021, the employer did not ensure that employees were protected from cave-ins by an adequate protective system while performing work in a trench that varied from 7 to 9 feet in depth. An employee was working in a trench which varied from 7 to 9 feet on a residential sewer tie in without a means of cave-in protection in place. The following condition exposed employees to struck-by/caught-in hazards.
