29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: On or about May 28, 2020, during the installation of new sanitary lines in an open trench at the work site located at the intersection of Perry Dr NW and Jackson Ave NW, Massillon, Ohio 44646; the employer/competent person did not conduct daily and or continuous inspections throughout the trenching/excavation process of the job site where employees were exposed to cave in hazards (trench with near vertical walls with a varying depth of 6.4 to 5.4 feet).

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about May 28, 2020, at a job-site located at the intersection of Perry Dr NW and Jackson Ave NW, Massillon, Ohio 44646; the employer did not ensure adequate cave-in protection was used to protect an employee working inside a trench with near vertical side walls and a depth varying from approximately 6.4 to 5.4 feet. The trench was determined to have type "C" soil.
