29 CFR 1910.178(c)(2)(vi)(a): Only approved power operated industrial trucks designated as EX shall be used in atmospheres in which combustible dust is or may be in suspension continuously, intermittently, or periodically under normal operating conditions, in quantities sufficient to produce explosive or ignitable mixtures, or where mechanical failure or abnormal operation of machinery or equipment might cause such mixtures to be produced. (a) The employer did not provide powered industrial vehicles designated EX for use in areas classified as Class II Division I or II, where combustible dust, such as but not limited to CX 36 containing wood flour and ground plastic (CX 36 kst = 2.16 bar meters per second), was used in production and where there was a history of fires occurring from dust leaks onto machinery on April 14, 2020 and oil heater failures on May 1, 2020.

29 CFR 1910.178(l)(4)(ii)(B): Refresher training shall be conducted when the operator has been involved in an accident or near-miss incident; (a) On or about June 11, 2020, the employer did not conduct refresher training for employees who operated powered industrial vehicles, such as but not limited to fork lifts and combi lifts in the workplace, when those employees were involved in multiple accidents.
