(a)  The employer did not provide powered industrial vehicles designated EX for use in areas classified as Class II Division I or II, where combustible dust, such as but not limited to CX 36 containing wood flour and ground plastic (CX 36 kst = 2.16 bar meters per second), was used in production and where there was a history of fires occurring from dust leaks onto machinery on April 14, 2020 and oil heater failures on May 1, 2020.
