29 CFR 1926.20(b)(1): Accident prevention responsibilities. It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about June 26, 2020, for the 223 Kohler Street, Pickerington, Ohio worksite: the employer failed to initiate and maintain programs necessary to comply with this part, such as but not limited to a fall protection safety program. The employer failed to develop, initiate and maintain a  fall protection program to prevent accidents from falling during residential framing work. The did not have equipment available to adequately initiate fall protection with guardrail systems, safety net systems or complete fall arrest systems. Due to this condition, framing carpentry workers were exposed to fall hazards of more than 20 feet without protection from falling.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about June 26, 2020, for the 223 Kohler Street, Pickerington, Ohio worksite: employees performed framing construction work without protection from falls. There were no guardrails systems, safety net systems or personal fall arrest systems put in place by the employer for employee protection. Four framing carpenters performed duties, such as but not limited to, OSB sheathing installation as a roof surface without use of fall protection. Due to these conditions, employees were exposed to fall hazards of more than 20 feet.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. On or about June 26, 2020, for the 223 Kohler Street, Pickerington, Ohio worksite: the employer did not provide a fall protection training program to include hazard recognition and procedures to be followed, such as use of a personal fall arrest system, guardrail system or safety net system, as part of a site specific fall protection plan. Employees performed framing work without any protection from failing while working at heights that exceeded 20 feet.
