29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a. Located at 161 Kohler Street, Lot 246, Pickerington, Ohio: On or about October 21, 2022, and at times prior, the employer did not ensure that employees working on the first floor of the new build home site were protected from falling through the hole leading to the basement, thereby exposing employees to fall hazards of approximately 9 feet.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  The employer does not protect each employee from the hazard of falling by the use of fall protection systems.  This most recently occurred on October 21, 2022, at a new build residential subdivision located at 161 Kohler Street, Lot 246, Pickerington, Ohio, 43147. The employer failed to ensure that employees were protected from fall hazards while performing framing work and installing sheathing on the roof trusses of the two-story new build residential home, thereby exposing them to a fall hazard of up to approximately 25 feet.  Antonio Aguilar Alva was previously cited for a Willful-Serious violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1593580, citation number 1, item number 1, and was affirmed as a final order on September 26, 2022, with respect to a workplace located at Lot# RVO 341, 482 Rochdale Run, Delaware, Ohio, 43015 where the employer failed to ensure that employees who were performing framing work from the second floor of a new build residential home were protected from fall hazards while sheathing the second floor, thereby exposing them to a fall hazard from approximately ten feet.   Antonio Aguilar Alva was previously cited for a Willful-Serious violation of this Occupational Safety and Health standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1563350, citation number 2, item number 1 and was affirmed as a final order on December 30, 2021, with respect to a workplace located at 750 Wharncliff Loop, Pickerington, Ohio 43147 where the employer failed to ensure that employees who were performing sheathing of the roof trusses were protected from fall hazards of approximately 25 feet.   Antonio Aguilar Alva was also previously cited for a Serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1480837, citation number 1, item number 2 and was affirmed as a final order on December 04, 2020, with respect to a workplace located at 223 Kohler Street, Pickerington, Ohio 43147 where the employer failed to ensure that employees who were performing sheathing of the roof trusses were protected from fall hazards of approximately 20 feet.

Located at the job site at 161 Kohler Street, Lot 246, Pickerington, Ohio: On or about October 21, 2022, and at times prior, the employer did not ensure that an effective safety and health program was maintained onsite to ensure that hazards were identified and corrected while employees performed framing work onsite. The hazards included, but were not limited to, operating nail guns without eye protection, and sheathing the roof at   heights of up to 25 feet without fall protection measures.  Antonio Aguilar Alva was previously cited for a Repeat-Serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1593580, citation number 2, item number 1, and was affirmed as a final order on September 26, 2022, with respect to a workplace located at Lot# RVO 341, 482 Rochdale Run, Delaware, Ohio, where employees operated nail guns without eye protection and worked from the second story without fall protection. Located at 161 Kohler Street, Lot 246, Pickerington, Ohio, 43147: On or about October 21, 2022, the employer did not ensure that employees who were operating pneumatic nail guns to install sheathing on the roof trusses utilized eye protection. As a result, employees were exposed to struck-by hazards associated with operation of the pneumatic nail guns.
