29 CFR 1926.300(b)(1): When power operated tools are designed to accommodate guards, they shall be equipped with such guards when in use.   On and about July 10, 2020, employees were exposed to laceration hazards while cutting concrete sill material at 1000 N. River Rd. Wausau, WI, when the Makita 7" angle grinder equipped with a segmented diamond blade did not have the guard installed.

29 CFR 1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On July 10, 2020, employees were cutting concrete sill material with an angle grinder at 1000 N. River Rd. Wausau, WI without using any form of dust suppression or respiratory protection and when the employer had not fully and properly implement the engineering controls and work practices specified in Table 1 for hand held grinders.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:  On and about July 10, 2020, employees were exposed to silica dust while cutting concrete sill material at 1000 N. River Dr. Wausau, WI when the employer did not implement a written exposure control plan that included a descriptions of all the tasks that involve exposure to respirable crystalline silica, the engineering controls and work practices for each tool and task, and the respiratory protection needed for dry cutting concrete materials.

29 CFR 1926.1153(i)(1): Communication of respirable crystalline silica hazards to employees-Hazard communication. The employer shall include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200). The employer shall ensure that each employee has access to labels on containers of crystalline silica and safety data sheets, and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section. The employer shall ensure that at least the following hazards are addressed: Cancer, lung effects, immune system effects, and kidney effects.  On and about July 10, 2020, employees were performing masonry work when the employer did not fully implement a HazCom program to communicate the hazards of respirable crystalline silica and the specific work practices necessary to protect employees from exposure.
