On or about July 13, 2020, located at 3232 Korg Street (lot 8), Powell, Ohio: the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while an employee performed framing work at a new build residential home. The employee worked unprotected from falling at the unprotected side and edge of the roof top. The fall distance was 9 feet 10 inches from the eave to the ground level.

On or about July 13, 2020, located at 3232 Korg Street (lot 8), Powell, Ohio: the employer failed to instruct employees on the avoidance of unsafe conditions while he conducted framing work at a new build residential home. The employee had worked exposed to a fall hazard off the roof top at an measured elevated height of 9 feet 10 inches to the ground level.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. On or about July 13, 2020, located at 3232 Korg Street (lot 8), Powell, Ohio: the employer failed to ensure that an employee who worked from the roof top of the second floor level of a new build residential home was protected while he installed framing lumber. The employee was exposed to a fall hazard of 9 feet 10 inches, from the unprotected side and edge near the eave of the roof top.
