29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about February 4, 2021, and at times prior, employees were operating portable circular saws and pneumatic nail guns to perform framing work without the use of eye protection thereby exposing them to struck-by hazards.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a. On or about February 4, 2021, employees utilized a portable extension ladder to access the roof and trusses of the backside of the residential structure being built. The ladder did not extend at least 3 feet above the upper landing surface or have alternative measures as mentioned above in use. As a result, employees were exposed to falls from heights of approximately 9 feet.

29 CFR  1926.1053(b)(6): Unsecured ladder(s) were used on surfaces that were not stable and level:  a. On or about February 4, 2021, employees were utilizing a 20 foot Werner portable extension ladder to access the roof and trusses to perform framing work. The ladder was not used on a surface that was stable and level and was not secured, thereby exposing employees to fall hazards of approximately 9 foot - 6 inches from the roof edge to the ground.

29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about February 4, 2021, and at times prior, the employer did not initiate and maintain safety programs to ensure their employees were protected from the hazards associated with residential framing construction. Employees were working from heights without fall protection, unsafely from ladders, and utilizing power tools without proper eye protection. As a result, employees were exposed to hazards such as, but not limited to, falls from heights and struck-by hazards associated with the framing activities.  Luis Felipe Rosales Aria was previously cited for a Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1483190, citation number 1, item number 1a and was affirmed as a final order on September 22, 2020, with respect to a workplace located at 3232 Korg St., Lot 8, Powell, Ohio.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a. On or about February 4, 2021, and at times prior, employees were working from the trusses of the overhang on the backside of the house installing sheathing without utilizing fall protection measures. As a result, employees were exposed to falls from height of approximately 9 to 13 feet.  Luis Felipe Rosales Arias dba R.A. Construccion was previously cited for a Serious violation of this Occupational Safety and Health Standard, which was contained in OSHA inspection number 1483190, citation number 2, item number 1, and was affirmed as a final order on September 22, 2020, with respect to a workplace located at 3232 Korg St., Lot 8, Powell, Ohio.
