29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. On or about July 21, 2020, the employer did not certify that each powered industrial truck operator had successfully completed training and evaluation prior to operating a powered industrial vehicle. This exposed employees to struck-by injuries. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. On or about July 21, 2020, the employer failed to ensure that scaffold planks were fully planked and installed, exposing employees to fall hazards approximately 23 feet high while standing on a metal scaffold and performing masonry activities. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
