29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  NBPL Building 158: Office 115: Employees performed drywall operations where N95 respirators were required due to the use of Westpac Joint Taping and Topping Joint Compound and Easy Sand 45 which contain crystalline silica. The employer did not have a written respiratory protection program. Employees were exposed to hazards such as respiratory irritants that could exacerbate underlying medical conditions.

NBPL Building 158: Office 115: Employees performed drywall operations where N95 respirators were required due to the use of Westpac Joint Taping and Topping Joint Compound and Easy Sand 45 which contain crystalline silica. The employer did not provide  medical evaluation to employees prior to requiring the use of the N95. This condition may exacerbate an underlying medical condition.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:  (Construction Reference 1926.103)  Building 158: Office 115: Employee(s) performed drywall taping and sanding operations wearing N95 filtering face piece respirators using Westpac Taping and Topping Joint Compound and Easy Sand 45 which contain crystalline silica. The employees stored N95 respirators in non-sealable, open grocery bags and in the open area where particulate silica dust was generated.  Employees were exposed to hazards such as respiratory irritants that could exacerbate underlying medical conditions.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  NBPL Building 158: Office 115: Employees performed drywall operations using Westpac Joint Taping and Topping Joint Compound and Easy Sand 45 which contain crystalline silica. The employees were unable to identify pictogram markings and other health hazards of the chemicals. The employer did not provide hazardous chemical training prior to the assignment of work. Employees were exposed to inhalation hazards.
