29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents: (a)K & E Construction LLC at 121 East Chapelwood Drive, Brandon, SD 57005: On or about and at times prior to August, 12 2020, the exposing employer did not ensure that each employee that was installing roofing materials using a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection. This condition exposed employees to projectile hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a)K & E Construction LLC at 121 East Chapelwood Drive, Brandon, SD 57005: On or about and at times prior to August 12, 2020, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a single-family home. Employees were installing asphalt shingles without a fall protection system in place. This condition exposed employees to a fall hazard of approximately 10 feet 4 inches. K & E Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1317301, citation number 1, item number 1a, and was affirmed as a final order on July 12, 2018, with respect to a workplace located at 340 North French Avenue, Sioux Falls, SD 57103.
