29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)K & E Construction LLC at 4404 East Leubacher Place, Sioux Falls, SD 57108: On or about and at times prior to August 17, 2021, the exposing employer did not ensure that employees were protected from falls while conducting roofing operations on a single-family home. Employees were installing asphalt shingles without a fall protection system in place. This condition exposed employees to a fall hazard of approximately 10 feet 5 inches.  K & E Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1488329, citation number 2, item number 1, and was affirmed as a final order on November 17, 2020, with respect to a workplace located at 121 East Chapelwood Drive, Brandon, SD 57005.  K & E Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1317301, citation number 1, item number 1a, and was affirmed as a final order on July 12, 2018, with respect to a workplace located at 340 North French Avenue, Sioux Falls, SD 57103.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  (a)K & E Construction LLC at 4404 East Leubacher Place, Sioux Falls, SD 57108: On or about and at times prior to August 17, 2021, the exposing employer did not ensure that each employee engaged in roofing operations was trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in roofing activities worked near the edge of a two story roof on a residential home without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 10 feet 5 inches.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)	The nature of fall hazards in the work area; b)	The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other          protection to be used;  d)	The role of each employee in the safety monitoring system when this system is used; e)	The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)	The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)	The role of employees in fall protection plans; h)	The standards contained in this subpart.  K & E Construction LLC was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1474091, citation number 2, item number 1b, and was affirmed as a final order on October 23, 2020, with respect to a workplace located at 1112 North Archer Driver, Sioux Falls, SD 57104.
