29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met, and the employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59)  A.)  LM Trim Carpentry, LLC, 2890 Copperleaf Drive, Erie, PA 16509, on or about September 9, 2020 and times prior thereto:  Employees were working with chemicals including, but not limited to, gasoline.  The employer did not have a hazard communication program.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions:  A.)  LM Trim Carpentry, LLC. 2890 Copperleaf Drive, Erie, PA 16509, on or about September 9, 2020 and times prior thereto:  Employees were operating equipment including, but not limited to, a pneumatic nail gun for framing and sheeting work activities.  The employer did not ensure that employees were wearing appropriate eye/face protection while operating the pneumatic nail gun.  LM Trim Carpentry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1306212, citation number 1, item number 1 and was affirmed as a final order on December 31, 2018, with respect to a workplace located at 4121 King Road, Sylvania, Ohio 43560.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  A.)  LM Trim Carpentry, LLC, 2890 Copperleaf Drive, Erie, PA 16509, on or about September 9, 2020 and times prior thereto:  Employees were exposed to a fall hazard of 16.2-feet when walking/working on the second floor of the structure.  Employees were not utilizing an acceptable means or method of fall protection.  LM Trim Carpentry, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1190594, citation number 2, item number 1 and was affirmed as a final order on January 5, 2017, with respect to a workplace located at 699 North Huntington Street, Medina, Ohio 44256.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
