29 CFR  1910.147(a)(2)(ii)(B): Lockout/tagout procedures were not implemented when servicing and/or maintenance was taking place during normal production operations when an employee was required to place any part of his/her body into area on a machine or piece of equipment's point of operation:  (a)Dakota Bodies, LLC at 201 20th Avenue SE, Watertown, SD 57770:  On or about and at times prior to August  26, 2020, the employer did not ensure lockout/tagout procedures were implemented when an employee was required to place any part of his body into an area on a machine or piece of equipment's point of operation. On August 26, 2020, an employee operating a 60-Ton Accurpress CNC hydraulic press brake (model #7606) in the door build area, was engaged in changing out the six-foot long lower die to accommodate the manufacture of steel door components to include the installation of an additional piece of  metal channel to even out the pressure, when the operator placed his hand in the point of operation to adjust the channel, another employee depressed the foot pedal actuating the press resulting in an amputation. This condition exposed an employee to amputation hazards.

29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section:   (a)Dakota Bodies, LLC at 201 20th Avenue SE, Watertown, SD 57770:  On or about and at times prior to August  26, 2020, the employer did not ensure procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section, including but not limited to the following machines or equipment:  (1)	60-Ton Accurpress Press Brake; (2)	100-Ton Accurpress Press Brake  Abatement Note:  Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.  The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  (1)	A specific statement of the intended use of the procedure;  (2)	Specific procedural steps for shutting down, isolating, blocking and securing machines or equipment to control hazardous energy;  (3)	Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them; and  (4)	Specific requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control measures.

29 CFR 1910.147(c)(7)(i):  The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees, and to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices:  (a)Dakota Bodies, LLC at 201 20th Avenue SE, Watertown, SD 57770:  On or about and at times prior to August  26, 2020, the employer did not ensure adequate training to ensure that the purpose and function of the energy control program was understood by employees, and to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices, including but not limited to the following machines or equipment:  (1)60-Ton Accurpress Press Brake; (2)100-Ton Accurpress Press Brake  Abatement Note:  The training shall include the following:  (1)	Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  (2)	Each affected employee shall be instructed in the purpose and use of the energy control procedure.  (3)	All other employees whose work operations are or may be in an area where energy control procedures may be utilized, shall be instructed about the procedure, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out.

29 CFR  1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded or guards were not designed and constructed to prevent  employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  (a)Dakota Bodies, LLC at 201 20th Avenue SE, Watertown, SD 57770:  On or about and at times prior to July 28, 2020, the employer did not ensure the point of operation on the 100-Ton Accurpress CNC hydraulic press brake (model# 710010) was properly guarded to prevent employees from having any part of the their body in the danger zone during machine operations. On July 28, 2020, an employee operating the press brake placed his fingers in the point of operation in an attempt to adjust the fence and inadvertently depressed the foot pedal, crushing the index and middle finger. The foot pedal was located directly below the point of operation. This hazard exposed the employees to an amputation hazard.  (b)Dakota Bodies, Inc. at 201 20th Avenue SE, Watertown, SD 57770:  On or about and at times prior to August 27, 2020, the employer did not ensure the point of operation on the 60-Ton Accurpress CNC hydraulic press brake (model# 7606) was properly guarded to prevent employees from having any part of the their body in the danger zone during machine operations. The operator is tasked in making multiple presses on door components. During machine operations, the operator depresses the foot pedal to actuate the press while holding the door. The foot pedal was positioned in close proximity to the machine and the point of operation allowing employee exposure to the danger zone while the machine is pressing the door components. The foot pedal was located directly below the point of operation. This hazard exposed employees to crushing and amputation hazards.
