29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:  A)  Maldonado Construction LLC, worksite located at 6401 Seaman Rd., Oregon, Ohio, 43616:  On or about October 7, 2020, the employer did not maintain an accident prevention programs to ensure compliance with common construction industry hazards, such as falls, ladder safety and personal protective equipment.

A) Maldonado Construction LLC, worksite located at 6401 Seaman Rd., Oregon, Ohio, 43616:  On or about October 7, 2020, the employer did not ensure employees were protected from eye injuries while installing shingles on a single story commercial building using Metabo HPT NV45AB2 pneumatic nailers.

29 CFR  1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  A) Maldonado Construction LLC, worksite located at 6401 Seaman Rd., Oregon, Ohio, 43616:  On or about October 7, 2020,  the employer did not ensure fall protection was implemented during commercial construction operations when workers were exposed to the hazard of falling approximately 12 feet while installing shingles on low slope single story structure.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder:   A) Maldonado Construction LLC, worksite located at 6401 Seaman Rd., Oregon, Ohio, 43616:  On or about October 7, 2020, the employer did not ensure the extension ladders was being used at an angle to prevent displacement. An employee using the ladder to install shingles from a single story commercial building in this condition employee was exposed to falls of approximately 9 ft.
