29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:   A)  Maldonado Construction LLC, worksite located at 1409 Finch Drive, Bowling Green,  OH  43402:  On or about March 24, 2021, the employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing roofing operations from elevated surfaces greater than six feet from the level below.

29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part:  A)  Maldonado Construction LLC, worksite located at 1409 Finch Drive, Bowling Green,  OH  43402:  On or about March 24, 2021, the employer did not maintain an accident prevention programs to ensure employee compliance and avoidance of  common construction industry hazards, such as falls and fall protection training.   Maldonado Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1496287, citation number 1 , item number 1 and was affirmed as a final order on December 11, 2020, with respect to a workplace located at 6401 Seaman Rd., Oregon, Ohio, 43616.

29 CFR  1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    A)  Maldonado Construction LLC, worksite located at 1409 Finch Drive, Bowling Green,  OH  43402:  On or about March 24, 2021,  the employer did not ensure employees were protected from falls while removing shingles on a two story residential structure. The employees were exposed to a fall distance of approximately 10 feet from a steep slope roof.  Maldonado Construction LLC previously cited for a violation of an equivalent Occupational Safety and Health Standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1496287, citation number 1 , item number 3 and was affirmed as a final order on December 11, 2020, with respect to a workplace located at 6401 Seaman Rd., Oregon, Ohio, 43616.
