29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about September 13, 2022 the employer Maldonado Construction LLC at jobsite located at 4575 River Rd. Toledo OH 43614, did not ensure the side rails of one portable aluminum extension ladder was extended at least three feet above the landing surface. Five employees were exposed to falls from approximately 19 feet or greater from the top of the second (roof) level to the decking below while using the ladder to access the second (roof) level to perform residential roofing activities on a single family home.

29 CFR  1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:   On or about September 13, 2022 the employer Maldonado Construction LLC at jobsite located at 4575 River Rd. Toledo OH 43614, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.   Maldonado Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.20(b)(1), which was contained in OSHA inspection number 1521368, citation number two, item number one and was affirmed as a final order on May 11, 2021 with respect to a workplace located at 1409 Finch Dr. Bowling Green OH 43402.  Maldonado Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.20(b)(1), which was contained in OSHA inspection number 1496287, citation number one, item number one and was affirmed as a final order on December 11, 2020 with respect to a workplace located at 6401 Seaman Rd. Oregon OH 43616.

Toledo OH 43614, did not ensure that each affected employee used appropriate eye or face protection when preforming residential roofing work on a existing residential structure, while exposed to potential struck by hazards (flying particles/debris) while using pneumatic nail guns   Maldonado Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.102(a)(1) which was contained in OSHA inspection number 1496287, citation number one, item number three and was affirmed as a final order on December 11, 2020 with respect to a workplace located at 6401 Seaman Rd. Oregon OH 43616.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about September 13, 2022 the employer Maldonado Construction LLC at jobsite located at 4575 River Rd. Toledo OH 43614, did not ensure employees were protected from falls while installing tar paper and shingles on the second (roof) level of a existing residential two story home. Six employees were exposed to a fall of approximately 25 feet and greater fall to the ground below.  Maldonado Construction LLC was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1521368, citation number two, item number two and was affirmed as a final order on May 11, 2021 with respect to a workplace located at 1409 Finch Dr. Bowling Green OH 43402.  Maldonado Construction LLC was previously cited for an equivalent violation of this Occupational Safety and Health Standard 1926.501(b)(10) which was contained in OSHA inspection number 1496287, citation number one, item number three and was affirmed as a final order on December 11, 2020 with respect to a workplace located at 6401 Seaman Rd. Oregon OH 43616.
