29 CFR 1926.20(b)(2):  The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)Heavy Construction, Inc. at 47238 271st Street, Sioux Falls, SD 57108: On or about and at times prior to October 15, 2020, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards of approximately 16 feet while installing steel corrugated roof panels over wood purlins without the use of a fall protection system. Additionally, the employer exposed employees to fall hazards while elevating employees on an inadequate personnel platform to gain access to the roof. The condition exposed employees to fall hazards throughout the operation.     Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. 29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use:  (a)Heavy Construction, Inc. @ 47238 271st Street, Sioux Falls, SD 57108: On or about and at times prior to October 15, 2020, the exposing employer did not ensure employees were protected from serious injury in that the employer utilized a forklift platform measuring 18 feet in length and 64.5 inches in width to lift employees to the roof of a commercial building under construction to install steel roof panels. The platform was not specifically designed to meet the ASME B56.6a-1994 requirements regarding the use of personnel on the platform. The platform was not equipped with adequate guardrails or a data plate identifying overall weight.  This condition exposed an employee to a fall hazard of approximately 16 feet.  Abatement Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.    Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all platforms used for elevating personnel with a rough terrain forklift truck comply with the design requirements specified in ASME B56.6a-1994, American Society of Mechanical Engineers, "Safety Standards for Rough Terrain Forklift Trucks",  Section 8.25, Platforms for Elevating Personnel, in the following areas: (1)Paragraph (b) which states, "floor dimensions which shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a length greater than the overall width of the truck measured across the load bearing tires plus 10 in. (250 mm) on either side. (2)Paragraph (f) which states, "information prominently indicated on the platform: (1) maximum work load including personnel and equipment; (2) weight of empty platform." 29 CFR  1926.760(a)(1): Each employee engaged in steel erection activity who is on a walking/ working surface with an unprotected side or edge more than 15 feet above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems:  (a)Heavy Construction, Inc. @ 47238 271st Street, Sioux Falls, SD 57108: On or about and at times prior to October 15, 2020, the exposing employer did not ensure employees were protected from fall hazards while installing 27-foot 8 inch long by 38-inch wide corrugated steel roof panels on the roof of a wooden pole-to-truss commercial building under construction.  Employees were installing the panels over wooden purlins without the use of a fall protection system.  This condition exposed an employee to a fall hazard of approximately 15 feet. 29 CFR  1926.1051(a):A stairway or ladder were not provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided:   (a)Heavy Construction, Inc. @ 47238 271st Street, Sioux Falls, SD 57108: On or about and at times prior to October 15, 2020, the exposing employer did not ensure that employees egressing from the roof of a commercial building under construction had points of access where there was a break in elevation 19" or more without a ladder provided. Employees egressed the roof by climbing down the webbing of the trusses and down walls to reach the lower level.  The condition exposed employees to a fall hazard of approximately 25 feet.  Heavy Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1051(a) which was contained in OSHA inspection number 1319023, citation number 1, item number 3 and was affirmed as a final order on August 21, 2018, with respect to a workplace located at 800 Dynamic Avenue, Harrisburg, SD 57032 .
