29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): At a worksite located at 7701 Independence Ave, Kansas City, MO: Workers were exposed to fall hazards. Workers were exposed to falls while working from the flat bed portion of various commercial trucks that are manufactured and assembled at the facility. a) This was demonstrated on or about October 27, 2020 when workers were observed working from a platform on the back of a rail truck. The platform was part of the structure of what would be described as the truck's flat bed. The platform had unprotected sides or edges exposing workers to a fall of 6 feet 8 inches to the ground below. b)This was demonstrated on or about March 3, 2021 when workers were observed working from the flat bed of a truck mounted crane. The flat bed was part of the structure of the truck where the crane was located. The flat bed had unprotected sides or edges exposing workers to a fall of 5 feet 4 inches to the ground below.

On or about March 4, 2021 and at times prior, the employer did not provide a written program that addressed the manner in which respirators would be cleaned, stored and maintained at the facility. The employer did not provide employees with a place to clean, store, and maintain their respirator in a manner that did not created a health hazards when activities such as, but not limited to grinding, and welding operations were taking place within the facility.

The employer failed to protect employees by not following the listed or labeled of electrical equipment used to power machinery. This was demonstrated on October 27, 2020 in that a relocatable power tap was permanently secured to metal conduit. The employer failed to protect employees by allowing the relocatable power tap to be zip tied to the conduit, which was not in accordance with the listing and labeling of the product.
