29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): On or about 11/30/2020, the employer failed to ensure that employees were protected from a fall. The scrap chute located by thermoformer line #9, had a surrounding that was about 12" in height in the front, and 23" in height on the sides and back. The opening of the chute was about 28.5" wide and 34" long., with a fall height of about 4' 10".

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) covered the following elements, however, the actions were not done in sequence as required by 29 CFR 1910.147 (d)(1)-(6): On or about 11/20/20, the employer failed to ensure that employees clearing jams on the shear of Machine # TF-9, LI/Lyle Industries Thermoformer Serial No. LM 4073, utilized lockout/tagout procedures in accordance with 1910.147 (d)(1) through 1910.47(d)(6) as follows: 1) Prepare for shutdown, 2) Shutdown machine or equipment, 3) Machine/equipment isolation, 4) Apply lockout device(s), 5) Relieve potentially hazardous energy sources, and 6) Verify energy isolation. Landmark Plastic Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.147(c)(4)(i), which was contained in OSHA inspection number 1415958, citation number 2, item number 1 and was affirmed as a final order on 1/14/2020 , with respect to a workplace located at 1331 Kelly Avenue, Akron, Ohio.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): On or about 11/20/20, the employer failed to ensure that the Machine # TF-9, LI/Lyle Industries Thermoformer Serial No. LM 4073 had adequate machine guarding in place. On the exit side of the Thermoformer, the shear guard had an opening at the bottom that was about 41" from the point of operation. The width of the opening was about 58", and the guard was about 44" off of the ground, allowing it to be easily bypassed. Landmark Plastic Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.212(a)(3)(ii), which was contained in OSHA inspection number 1415958, citation number 1, item number 2a and was affirmed as a final order on 1/14/2020 , with respect to a workplace located at 1331 Kelly Avenue, Akron, Ohio.
