29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On December 15, 2020, at the above addressed jobsite, employees performing roofing work on a pitched roof having a ground to eave height of approximately twenty (20') feet above the ground, were not provided personal fall arrest systems or other means of fall protection, thereby exposing the employees to fall hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. JM Superior Roofing LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1459185, citation number 1, item number 1, and was affirmed as a final order on February 20, 2020, with respect to a workplace located at 125 Woodstock Ave., Kenilworth, Illinois.
