29 CFR 1910.28(b)(2)(i):(2) Hoist areas. The employer must ensure: (i) Each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by: (A) A guardrail system; (B) A personal fall arrest system; or (C) A travel restraint system: a) On December 12, 2020, a "B" Operator fell 12 feet from the Building 52 new addition second story loading area while in the process of removing pallet banding straps from a pallet near the loading area edge. The loading area gate was open and the "B" operator was not wearing a personal fall arrest system or attached to a travel restraint system. b) From mid-October, 2020, through December 12, 2020, a process running in Building 52 required three ice pallets a day. The ice pallets were normally received at the Building 52 new addition second story loading area. Two or more employees were required to move the ice pallets with a pallet jack from the second story loading area to the process area requiring the ice. The employee(s) not operating the pallet jack were pushing or pulling the ice pallet within the six-foot swing radius of the loading area gate without donning a personal fall arrest harness or attaching to a travel restraint system.
