29 CFR 1926.451(g)(1)(vi): Employee(s) performing overhand bricklaying operations from a supported scaffold were not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity):  a) On or about December 21, 2020, employees were performing bricklaying from a tubular welded frame scaffold and were not protected from falling greater than 25 feet along open sides and ends of the scaffold.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about December 21, 2020, employees were performing bricklaying work on a three-story multi-unit residential building without fall protection, exposing employees to fall hazards greater than 25 feet.

29 CFR 1904.39(a)(1): The employer did not report the death of an employee resulting from a work-related incident to OSHA within eight (8) hours, either by telephone or in person to the OSHA Area Office that is nearest to the site of incident, by telephone to the OSHA toll-free central telephone number, 1-800-321-OSHA (1-800-321-6742), or by electronic submission using the reporting application located on the OSHA public web site at www.osha.gov:       a) The employer did not report the death of an employee resulting from a work-related incident that occurred on or about December 21, 2020, to OSHA within eight (8) hours of the employee's death.  The employee passed on January 4, 2021. The death was reported to OSHA on February 5, 2021.
