29 CFR 1926.1153(c)(1):): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1: a) Summit Sealants & Restoration Services, Inc., at 1391 Speer Blvd, Denver CO, 80204: On and before December 30, 2020, for each subcontractor employee engaged in a task identified on Table 1, the controlling employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, in that a Hilti, TE-1000-AVR, Concrete Breaker; a Bobcat, skid steer with hydraulic breaker attachment and a Stihl, TS-420 cutting saw, the tools were not used with a water delivery system that supplied a continuous stream or spray of water at the point of impact. Eight subcontractor employees were breaking up and removing 11 inch thick concrete on the parking garage ramp, from the 2nd level, up to the 3rd level. Concrete contains respirable crystalline silica. Subcontractor Employees had no wet method in use to control the concrete dust from becoming airborne and employees were not wearing respirators to prevent inhalation of the concrete dust. This condition exposed the subcontractor employees to a respirable crystalline silica hazard.

29 CFR 1926.1153(d)(2)(i): The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. a) Summit Sealants & Restoration Services, Inc., at 1391 Speer Blvd, Denver CO, 80204: On and before December 30, 2020, the controlling employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. 8 subcontractor employees were breaking up and removing, 11 inch thick concrete on the parking garage ramp, from the 2nd level, up to the 3rd level. Concrete contains respirable crystalline silica. The employer did not ensure that employees and subcontractor employees fully and properly implemented the engineering controls specified for handheld powered chipping tools , handheld power saws and a skid steer, hydraulic breaker attachment use on Table 1. The employer did not evaluate employee exposure to respirable crystalline silica. This condition exposed the employees to a respirable crystalline silica hazard.
