29 CFR 1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: New Cumberland Station Subdivision located at 3110 Sports Avenue, Smyrna, GA 30080, Excavation: On or about 01/05/2021, employees in the process of installing 24-inch drain pipe inside of an excavation that measured 9-feet deep by 15-feet wide by 25-feet long were not protected from hazards created by loose material falling and/or rolling back into the excavation. The spoil pile was approximately 10 feet in height and was resting on the edge of the excavated area.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: New Cumberland Station Subdivision located at 3110 Sports Avenue, Smyrna, GA 30080, Excavation: On or about 01/05/2021, the employer failed to provide a means of egress from the excavation, in that a ladder, ramp or other means of egress was not provided to employees working in an excavation that measured 9-feet deep by 15-feet wide by 25-feet long. North Georgia Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1261268, citation number 1, item number 1 and was affirmed as a final order on 01/25/2018, with respect to a workplace located at Avalon Crossing II located at 2855 Old Milton Place, Alpharetta, GA 30009.

New Cumberland Station Subdivision located at 3110 Sports Avenue, Smyrna, GA 30080, Excavation: On or about 01/05/2021, the employer exposed employees to cave-in hazards while working in a 9-feet deep by 15-feet wide by 25-feet long excavation, in that a cave-in protection system was not provided in the location where an employee was installing and grouting a 24-inch pipe to the manhole. North Georgia Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1261268, citation number 1, item number 2 and was affirmed as a final order on 01/25/2018, with respect to a workplace located at Avalon Crossing II located at 2855 Old Milton Place, Alpharetta, GA 30009.
