29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  a) Excavation located on 1735 Pilgrim Road, Cumming, GA 30040: On 01/02/2024, the employer exposed employees to engulfment/cave-in hazards, in that the employees were not trained to recognize and avoid unsafe conditions, including, but not limited to, no protective system in excavation, failure to provide a safe means of access/egress, and failure to utilize the necessary personal protective equipment while performing work in and around an excavation.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Excavation located on 1735 Pilgrim Road, Cumming, GA 30040: On 01/02/2024, the employer did not ensure that employees working in a trench/excavation were protected from falling material by the use of head protection while installing bricks and cement at the manhole pipe connections located inside the excavation.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) New residential construction located at Berkley Mill Subdivision at 1735 Pilgrim Road Cumming, Georgia 30040, Excavation: On 1/2/2024, the employer failed to provide a means of egress from the excavation, in that a ladder, ramp, or other means of egress was not provided to employees working in an excavation installing bricks and concrete at the drainage pipe openings to the manhole.  North Georgia Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1508555, citation number 2, item number 1 and was affirmed as a final order on 07/12/2021, with respect to a workplace located at 3110 Sports Avenue Smyrna, GA 30080.  North Georgia Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 1261268, citation number 1, item number 1 and was affirmed as a final order on 01/25/2018, with respect to a workplace located at Avalon Crossing II located at 2855 Old Milton Place, Alpharetta, GA 30009.

The spoil pile was approximately 7-feet in height and was resting on the edge of the excavated area.  North Georgia Grading, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1508555, citation number 1, item number 1 and was affirmed as a final order on 07/12/2021, with respect to a workplace located at 3110 Sports Avenue Smyrna, Georgia 30080.
