29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section. On or about 5/29/20, the employer failed to certify to OSHA that the following hazards have been abated. a) Lettuce Processing Area: On or about February 4, 2021, and at times prior, the employer exposed employees to caught-in hazards, in that the employer did not document written, machine-specific procedures for the control of hazardous energy to be used by employees while performing sanitation activities on equipment including, but not limited to, the Lettuce Line Inspection Conveyor. b) Lettuce Processing Area: On or about February 4, 2021, and at times prior, the employer exposed employees to hazards associated with recordkeeping, in that the employer did not document the periodic inspections of control of hazardous energy procedures which were used to isolate equipment while employees perform sanitation work on machines including, but not limited to, the Lettuce Line Inspection Conveyor.
